Deutsche Bank National Trust Company ("Deutsche Bank"); MERSCORP, Inc., and Mortgage Electronic Registration Systems, Inc. (collectively, "MERS"); and CIS Financial Services, Inc. ("CIS"), petitioned the Alabama Supreme Court for permission, pursuant to Rule 5, Ala. R. App. P., to appeal the trial court's denial of their motions seeking to dismiss the claims of the plaintiffs-- Walker County and Rick Allison, in his official capacity as judge of probate of Walker County (collectively, "plaintiffs")--seeking class-based relief on behalf of themselves and all other similarly situated Alabama counties and judges of probate. At issue was a particular aspect of the mortgage-securitization process. Deutsche Bank served as trustee for numerous residential mortgage-backed security ("RMBS") trusts containing mortgages for properties located in Walker County and other Alabama counties. In this case, plaintiffs initiated the underlying litigation against Deutsche Bank "seeking to recover the benefit [Deutsche Bank allegedly] received by relying on the real property recording systems of the Counties without compensating the Counties for that benefit." Plaintiffs alleged that Alabama law requires mortgage assignments to be recorded; therefore, they maintained, the MERS system used by Deutsche Bank avoided the proper recording of mortgage assignments, along with the payment of the requisite filing fees, and has resulted in lost income to county governments. The Alabama Supreme Court reversed the trial court and remanded: “We see no intent in the Code section to embrace a mandatory rule that all conveyances, which would include not only real-property conveyances but also apparently all conveyances of personal property, are required to be recorded in the probate court. Instead, 35-4-50 simply states that the probate court is where conveyances that are required by law to be filed must be filed. Section 35-4-51, in turn, is the Code section that provides for the recording of conveyances generally, and it places a duty on only the probate court to accept those filings. This case was an estate-administration case that was only partially before the Alabama Supreme Court. Perry Eugene Cox, Jr. ("Cox"), appealed a judgment made final by the Shelby Circuit Court ("the trial court") under Rule 54(b), Ala. R. Civ. P. Specifically, the trial court held that Cox's counterclaim against his sisters, Jennie Jo Cox Parrish, Debra Cox McCurdy, and Shirley Cox Wise, as coexecutors of the estate of their father, Perry Eugene Cox, Sr., was time-barred by Alabama's nonclaims statute, 43-2-350, Ala. Code 1975. The trial court dismissed Cox's counterclaim and certified its judgment as final and appealable, and Cox appealed. Because the trial court exceeded its discretion in certifying its dismissal of Cox's counterclaim under Rule 54(b), the Supreme Court determined no final judgment existed and the Court lacked jurisdiction to decide this appeal. Several former employees of Alabama Psychiatric Services, P.C. ("APS"), filed a putative class action against APS and Managed Health Care Administration, Inc. ("MHCA"), an affiliate of APS, alleging APS had not paid the former employees for unused vacation time after they lost their jobs when APS went out of business. APS and MHCA moved the circuit court to compel arbitration pursuant to arbitration agreements the plaintiffs had entered into with APS. APS and MHCA asked the circuit court to determine, as a threshold question, whether class arbitration was available in this case because the arbitration agreements at issue did not expressly mention class arbitration. The circuit court issued an order granting the motion to compel arbitration, declining to decide whether class arbitration was available, concluding that that issue was to be decided by the arbitrator. The case proceeded to arbitration. The arbitrator issued a clause-construction award ("the award"), concluding that the relevant arbitration agreements authorized class arbitration in this case. APS and MHCA sought review of the award by the circuit court, which denied the motion to vacate the arbitrator’s award. The parties then applied to the Alabama Supreme Court, which noted multiple procedural irregularities in the circuit court’s order. The issue of whether the circuit court erred regarding its order not vacating the arbitration agreement was not properly before the Supreme Court. APS and MHCA attempted to challenge that part of the order compelling arbitration in which the circuit court declined to decide the availability of class arbitration. However, to properly challenge that aspect of the earlier order, APS and MHCA should have appealed the order. APS and MHCA also argued the circuit court erred by failing to apply a de novo standard of review of the arbitrator’s award. The Supreme Court determined the circuit court did not err in this respect. The Supreme Court therefore affirmed the circuit court in denying the motion to vacate the arbitrator’s award, and dismissed appeal 1171150 as redundant. View "Alabama Psychiatric Services, P.C. v. Pope, McGlamry, Kilpatrick, Morrison & Norwood, P.C. ("the firm"), appealed a circuit court judgment awarding postjudgment interest to Jason DuBois. DuBois sued asserting a worker's compensation claim and tort claims against various defendants. DuBois was represented in the underlying action by two attorneys who were employed by the firm. After DuBois's attorneys ended their employment with the firm, DuBois terminated the firm's representation. The two former attorneys of the firm, however, continued to represent DuBois. The firm then intervened in the action, asserting an attorney-fee lien and claiming attorney fees and expenses. DuBois subsequently obtained settlements from the defendants, which disposed of all the claims he had asserted, but the firm's claim for attorney fees and reimbursement of expenses remained pending. The trial court ordered the clerk of the Etowah Circuit Court ("the trial-court clerk") to deposit the settlement funds "in an interest bearing account and to retain said funds until further order of the court." Following a bench trial on the attorney-fee dispute, the trial court entered a judgment finding that the firm was not entitled to any fees or reimbursement of expenses. The firm appealed, but the Court of Appeal affirmed the trial court. The Alabama Supreme Court reversed, concluding there was no money judgment against the firm that would permit the accrual of postjudgment interest. The settlement sum interpleaded into court from the underlying case "was not money that [the firm] owed to [DuBois] pursuant to any note, mortgage, judgment, or other indebtedness, nor was it awarded as the result of any legal claims against [the firm]." This case involved a dispute over the planned construction of a high-rise condominium along the Gulf of Mexico in Orange Beach, Alabama. The Perdido Dunes property shared common boundaries with property containing other beachfront condominium buildings. Phoenix East, a Condominium, was a 14-story condominium with 158 residential units located adjacent to and directly east of the Perdido Dunes property. In 2004, Hurricane Ivan effectively destroyed an 8-unit portion of Perdido Dunes. The City's zoning regulations prohibited Perdido Dunes from separating into two parcels, but the City would allow Perdido Dunes to split the PDAI (the condominium association) into two neighborhood associations governed by a master association. The ownership interest in the Master Association would comprise the unit owners of two newly created neighborhood associations, namely the Perdido Dunes Tower Condominium Owners Association, Inc. and the Perdido Dunes 2006 Condominium Owners Association, Inc. The PD Tower Association would serve as the association for Perdido Dunes Tower, a prospective 10-story, 20-unit condominium building measuring 56 feet in length that was to be developed by Perdido Dunes Tower, LLC ("Tower LLC"), on the land where the 8-unit building had been located. The City issued a building permit to Tower LLC in 2008, authorizing it to begin construction of Perdido Dunes Tower. The planned construction was interrupted in 2015, when the City notified Tower LLC of concerns relating to the width of the proposed Perdido Dunes Tower in relation to the neighboring properties, namely Phoenix East and Phoenix VIII. The City directed that Tower LLC could not begin substantial construction on the building, and the City informed Tower LLC that its building permit would be revoked. If the building permit were revoked, Tower LLC would be required to apply for a new permit under updated City building standards, which, according to the trial court's judgment being challenged on appeal, "would have required significant additional undertakings by the Tower LLC to attempt to complete the building of a compliant tower structure." To challenge the proposed Perdido Tower project, the Phoenix entities sued, arguing the consent decree that resulted between the City and the Master Association was void. The Alabama Supreme Court determined the Phoenix VIII Association lacked standing to challenge the consent decree; the Court ruled Phoenix East Association had standing, but "its challenge to the consent decree is unavailing, and the consent decree is affirmed." Daniel Donaldson appealed the grant of summary judgment in favor of Country Mutual Insurance Company ("Country Mutual"). The underlying action stemmed from a November 2015 accident in which Donaldson, while working in a construction zone on the west side of Bailey Cove Road in Madison County, Alabama, was struck by a sport-utility vehicle, owned and driven by Gregory Johnston. As a result of the collision, Donaldson suffered severe injuries to one of his legs that ultimately required the amputation of the leg. Donaldson sued Johnston and Country Mutual, asserting claims of negligence and wantonness against Johnston and asserting that Country Mutual was vicariously liable for Johnston's conduct under theories of agency and respondeat superior. At the time of the underlying accident, Johnston was working as an insurance agent under an "agent's agreement" with Country Mutual and a number of other companies that were collectively referred to in that agreement as "Country Insurance and Financial Services." Country Mutual filed a motion for a summary judgment, arguing that Johnston was not its agent or employee but, instead, was an independent contractor. Country Mutual further argued that, even assuming Johnston was its employee, his actions in relation to the accident were outside the line and scope of his alleged employment. The Alabama Supreme Court concluded Donaldson failed to submit substantial evidence of the existence of a genuine issue of material fact to support its claims against Country Mutual to defeat Country Mutual's summary judgment motion. W.R. Meriwether, Factors & Drayage, LLC ("Meriwether"), and Gregory Thompson appealed adverse judgments entered in Meriwether and Thompson's action against the Pike Road Volunteer Fire Protection Authority ("the Fire Authority") and other defendants. Meriwether and Thompson each owned parcels of real property that adjoined a 10-acre piece of property owned by the Fire Authority. All three parcels were located in the Town of Pike Road ("Pike Road"). Pursuant to a Pike Road zoning ordinance, the parcels were located in an area zoned for "low density, single-family residential development." Materials submitted to the trial court indicated the Fire Authority planned to build a fire station on its 10-acre parcel. Meriwether and Thompson sued the Fire Authority and Pike Road, along with the members of the Fire Authority's board of directors, the Pike Road Planning Commission, the chairman of the Planning Commission, and the Pike Road planning director. In their complaint, Meriwether and Thompson sought a judgment declaring that the Fire Authority is subject to the referenced zoning ordinance and that constructing a fire station on its property would be a violation of that ordinance. The Alabama Supreme Court concluded the Fire Authority did not qualify as a body entitled to an exemption from zoning regulation. The State of Alabama petitioned the Alabama Supreme Court for a mandamus relief. The State sought the vacation of a circuit court order holding certain statutes and acts of Alabama unconstitutional, and to require the Mobile circuit clerk to withhold 10% of the funds collected as court costs and fees from litigants in Mobile County until such time the State adequately funds the clerk’s office. This matter arose out of a criminal proceeding in which a grand jury indicted Mandy Brady for trafficking methamphetamine. Brady posted bond on that charge and was released; however, she was subsequently arrested on a new charge, and the State moved to revoke her bond. The circuit court granted the State's motion and revoked Brady's bond. Despite the fact that Brady was in State custody when the circuit court revoked the bond, Brady did not appear at her scheduled trial on the trafficking charge. When Brady failed to appear, the circuit court issued a show-cause order to the circuit clerk, the Mobile County sheriff, "and/or" the warden of the Mobile County jail seeking an explanation as to why Brady was released from jail despite the fact that the circuit court had revoked her bond. The warden testified that he never received notice from the circuit clerk's office that Brady's bond had been revoked; the circuit clerk testified that an employee in her office had properly entered the circuit court's order revoking Brady's bond before Brady was released from the county jail but that employee apparently failed to send notice of the order to the county jail. The circuit clerk explained that this mistake occurred because she did not have the ability to fully train her employees before giving them the responsibility of managing a circuit judge's docket; ultimately the problem, according to the circuit clerk, was that she did not have adequate funding to retain well trained personnel. The Supreme Court determined the circuit court exceeded its authority in the Brady matter, “purporting to award declaratory and injunctive relief no party had requested.” The State’s petition for mandamus relief was granted. Plaintiffs David and Lisa McDaniel petitioned the Alabama Supreme Court for a writ of mandamus to direct the Shelby Circuit Court to vacate its order staying the proceedings against defendants Southern Craftsman Custom Homes, Inc. ("SCCH"); Jeffrey Rusert; Larry Curry, Sr.; SouthFirst Bancshares, Inc., d/b/a SouthFirst Bank ("SouthFirst"); Mari Gunnels; and Danny Keeney. At the time of this opinion, Rusert was awaiting the outcome of a federal criminal investigation against him. In 2017, the McDaniels contacted Rusert for the purpose of entering into an agreement with SCCH to build a house. According to the McDaniels, Rusert represented himself as the president of SCCH. At some point, Rusert recommended that the McDaniels speak with Gunnels, who worked for SouthFirst, to secure a loan to pay for the construction of the new house. In November 2017, with Gunnels's assistance, the McDaniels began the process of applying for a construction loan with SouthFirst. The loan closing occurred on January 26, 2018. The McDaniels executed, among other agreements, a written construction-loan agreement, a promissory note, and a construction-loan disbursement agreement. The McDaniels met with Rusert to discuss some concerns they had with the ongoing construction. During that meeting, Rusert provided the McDaniels with a credit application from a local building-supply company and asked them to execute it so that, he said, he could use the McDaniels' credit to purchase building materials and supplies. The McDaniels learned that the company refused to do business with SCCH, Rusert, and Curry because all three had purportedly failed to pay significant amounts owed the company. The McDaniels immediately contacted Gunnels and placed a "stop-payment" order on the most recent draw request from SCCH and Rusert. Thereafter, the McDaniels sued SCCH, Rusert, Curry, SouthFirst, Gunnels, and Keeney. In their complaint, the McDaniels sought damages for negligence, suppression, fraudulent misrepresentation, civil conspiracy, conversion, and the infliction of emotional distress. The McDaniels further alleged breach-of-contract claims against SouthFirst, SCCH, Rusert, and Curry, as well as a claim of breach of fiduciary duties against SouthFirst. Finally, the McDaniels sought a judgment against SouthFirst, Gunnels, and Keeney declaring the loan agreement and mortgage void. Rusert and SCCH moved to stay the civil proceedings against them pending the outcome of a federal criminal investigation against Rusert, which the trial court granted. The Alabama Supreme Court determined, however, the McDaniels established a clear legal right to relief from the trial court's order. Accordingly, the Supreme Court granted the petition for a writ of mandamus and directed the trial court to vacate its order staying the underlying case. Douglas Ghee, as the personal representative of the estate of Billy Fleming, appealed a circuit court order dismissing a wrongful-death claim brought against USAble Mutual Insurance Company d/b/a Blue Advantage Administrators of Arkansas ("Blue Advantage"). Fleming presented to the emergency department complaining of constipation and abdominal pain. He would ultimately need a colectomy, but the hospital informed him Blue Advantage had decided that a lower quality of care (continued non-surgical management) was more appropriate than the higher quality of care (surgery) that Fleming's surgeon felt was appropriate. Fleming and his family had multiple conversations with agents of Blue Advantage in an unsuccessful attempt to convince the company that the higher surgery was the more appropriate course of care. Ultimately, an agent of Blue Advantage suggested to Fleming that he return to the hospital in an attempt to convince hospital personnel and physicians to perform the surgery on an emergency basis. For five days, Fleming would present to the emergency room, each time he was treated by non-surgical means, then returned home. On the evening of July 15, 2013, Fleming's condition had deteriorated such that he had to be intubated. He died after midnight of septic shock due to a perforated sigmoid colon with abundant fecal material in the peritoneal cavity. A lawsuit was filed against Blue Advantage, asserting that the combined negligence of the hospitals and clinics involved and Blue Advantage, proximately caused Fleming's death. Because the trial court determined that Ghee's allegations against Blue Advantage as stated in the original complaint were defensively preempted by ERISA, the Alabama Supreme Court found Ghee should have had the right to amend his complaint to clarify his state-law claims. Because the Court concluded that Ghee should have been afforded the right to amend his complaint, it reversed the judgment of the trial court and remanded for further proceedings. View "Ghee v.
