Frederick Burkes, Sr. appealed a circuit court judgment entered in favor of James Franklin in an action initiated by Burkes. In March 2020, Burkes defeated Franklin, the incumbent, in a primary election for the office of constable for District 59 in Jefferson County, Alabama. Burkes was unopposed in the general election and was declared and certified as the winner of the election on Friday, November 13, 2020. Thereafter, Franklin sent a letter to the Jefferson Probate Court informing the probate court that Burkes had not filed an official bond within 40 days of the declaration of Burkes's election to the office of constable. The probate court notified the Governor that the bond had not been posted, making the office vacated by operation of law. The Governor thereafter appointed Franklin to the office of constable for District 59. On April 22, 2021, Burkes, acting pro se, initiated this action, which he identified as a quo warranto action, with the circuit court. Burkes alleged in his complaint that he had been sworn into the office of constable on January 4, 2021, and that he had filed an official bond on December 31, 2020, which he contended was timely pursuant to § 36-23- 4, Ala. Code 1975. Also acting pro se, Franklin filed an "answer" in which he also moved for a "summary judgment." In summary, Franklin asserted that Burkes had vacated the office of constable by failing to comply with the pertinent statutory procedure concerning the payment of official bonds. Franklin requested, among other things, that Burkes be ordered to cease and desist all activities concerning the office of constable and that Burkes's quo warranto action be "dismissed with prejudice." The Alabama Supreme Court found that Burkes's failure to give the circuit court security for the costs of this action deprived the circuit court of subject-matter jurisdiction over the action. Because the circuit court lacked subject-matter jurisdiction over this action, its judgment was void. Because a void judgment will not support an appeal, this appeal was dismissed. View "Burkes v. The Mobile County Board of Equalization ("the Board") petitioned the Alabama Supreme Court for a writ of mandamus directing the Mobile Circuit Court ("the trial court") to dismiss, for lack of subject-matter jurisdiction, an appeal filed by Atwood Drilling, Inc. ("Atwood"), challenging the Board's final assessment of ad valorem property taxes. This case concerns a dispute between Atwood and the Board as to the assessed value of personal property owned by Atwood ("the property"). Atwood timely filed a notice of appeal to the trial court, challenging the assessment as too high. the Board moved to dismiss Atwood's appeal, alleging: (1) taxes on the property had become delinquent because they had not been paid by January 1, 2021; and (2) by failing to pay the disputed amount before January 1, 2021, Atwood had not satisfied a jurisdictional requirement in § 40-3-25 -- specifically, the requirement that, when appealing a tax assessment, a taxpayer who has not executed a supersedeas bond must pay the assessed taxes before they become delinquent. In support of the motion to dismiss, the Board attached a receipt from the office of the Mobile County Revenue Commissioner ("the Commissioner") indicating that Atwood had not paid the assessed taxes as of January 19, 2021. Atwood alleged that it had sent the Commissioner via certified mail on December 10, 2020, and suggested that delivery had been likely delayed because of service disruptions related to the COVID-19 pandemic. The Board argued that the "mailbox rule" in § 40-1-45 did not extend to undelivered tax payments. At some point following the Board's filing of the motion to dismiss, Atwood paid the tax bill, including penalties and interest, with a second check. After holding several hearings on the matter, the trial court, without stating the findings on which its decision was based, entered an order denying the Board's motion to dismiss on September 10, 2021. Because the appeal was not perfected, the Alabama Supreme Court determined the trial court lacked subject matter jurisdiction, and should have granted the Board's motion to dismiss. Alabama Power Company ("Alabama Power"), B&N Clearing and Environmental, LLC ("B&N"), and Jettison Environmental, LLC ("Jettison") petitioned the Alabama Supreme Court for a writ of mandamus directing the Montgomery Circuit Court to vacate its order denying their motions to transfer this action to the Autauga Circuit Court and to enter an order granting the motions. In 2019, Zane Yates Curtis, a North Carolina resident who was employed by B&N, was killed when a portion of his tractor-trailer made contact with an energized overhead power line in Autauga County. At the time, Zane was dumping mulch at a landfill in Prattville that was operated by JB Waste Connection, LLC. Rachel Curtis, as the administrator of Zane's estate, filed a complaint for worker's compensation benefits against B&N in the Montgomery Circuit Court. B&N was a Delaware limited-liability company whose principal address was in Houston, Texas. It did not have a physical office in the State of Alabama, it did not have a principal office in Montgomery County or any other Alabama county, and none of its members were residents of Montgomery County or any other Alabama county. Rachel amended her complaint to include a workers’ compensation claim against B&N, and negligence and wantonness claims against Alabama Power, Jettison, and JB Waste. Alabama Power was an Alabama corporation that had its principal place of business in Birmingham. Jettison was an Alabama limited-liability company that had its principal place of business in Autauga County. JB Waste was an Alabama limited-liability company with an office in Montgomery County and did business in Montgomery County and Autauga County. B&N filed answers to both complaints, specifically including the defense of improper venue. Because venue in Montgomery County was not proper as to B&N when the action was commenced, the Alabama Supreme Court found the trial court exceeded its discretion in denying the motions to transfer the case to Autauga County, where venue would have been proper. In 2003, the Alabama Legislature and the citizens of Greene County voted to allow nonprofit organizations in that county to operate bingo games for fundraising purposes. Greenetrack, Inc. ("Greenetrack"), which was not a nonprofit organization, almost immediately began offering live and electronic bingo games at its gambling facility. From 2004 to 2008, Greenetrack reaped vast profits under the guise that its whole casino-style bingo operation was constantly being leased and operated by a revolving slate of local nonprofit organizations, whose nominal role earned them a tiny fraction of the bingo proceeds. Eventually, the Alabama Department of Revenue ("the Department") audited Greenetrack, found that its bingo activities were illegal, and concluded that it owed over $76 million in unpaid taxes and interest. Following a decade of litigation, the Alabama Tax Tribunal voided the assessed taxes on the threshold ground that Greenetrack's bingo business (regardless of its legality) was tax-immune under a statute governing Greenetrack's status as a licensed operator of dog races. The Department appealed, and the Alabama Supreme Court reversed, rejecting the statutory analysis offered by the Tax Tribunal and circuit court. Judgment was rendered in favor of the Department. The City of Warrior ("Warrior") and the Town of Trafford ("Trafford") petitioned the Alabama Supreme Court for a writ of mandamus to direct a circuit court to vacate its order denying their motions for a summary judgment in this tort action filed by plaintiff James Griffin, as the personal representative of the estate of James R. Olvey, and to enter a summary judgment in Warrior's and Trafford's favor on the basis of immunity. A Warrior police officer saw a cehicle operated by Donald Wright run a red light. Though the officer tried to stop Wright's vehicle, Wright sped away and the officer pursued. A Trafford officer joined in pursuit. When Wright entered the interstate to avoid the police chase, the officers stopped their pursuit. Approximately three quarters of a mile from where the officers ceased their pursuit, Wright's vehicle collided head-on with a vehicle driven by Olvey in a southbound lane. Olvey died as a result of the collision. When Wright was apprehended at the collision scene, a syringe was found hanging from his right arm. Subsequent testing revealed that, at the time of the collision, he was under the influence of both marijuana and cocaine. Wright was subsequently criminally indicted in connection with Olvey's death. Griffin, as the personal representative of Olvey's estate, later sued, among others, the two officers and their respective Town employers, alleging among other things, that Olvey died as the result of the allegedly unskillful, negligent, and/or wanton conduct of the officers in pursuing Wright while carrying out duties. As to each municipality, Griffin further alleged, based on a theory of respondeat superior, that they were vicariously liable for the purported wrongful conduct of the officers. After review, the Supreme Court determined Warrior and Trafford demonstrated a clear legal right to summary judgment in their favor on the basis of immunity. Larry Lang appealed the grant of summary judgment in favor of Cabela's Wholesale, LLC ("Cabela's"), in his product-liability action against Cabela's based on the alleged failure of a hunting tree stand. On November 29, 2016, Lang was starting to climb down the ladder of a hunting tree stand. A telescoping mechanism in the ladder failed, and Lang fell to the ground and was severely injured. As a result, he had limited ability to walk, incurred significant medical bills, and incurred expenses to modify his home. The Alabama Supreme Court found that under the clear language of 6-5-521(b)-(d), Ala. Code 1975, commonly known as the innocent-seller act, Cabela's was not entitled to a summary judgment on Lang's claims against Cabela's as the seller of the tree stand. Cabela's was entitled to a summary judgment, however, on Lang's claims against Cabela's as the designer and manufacturer. Hunter Halver Brown petitioned the Alabama Supreme Court for certiorari review in which a circuit court had denied Brown's motion to dismiss the indictment against him notwithstanding the State's purported failure to comply with the Uniform Mandatory Disposition of Detainers Act, 15-9-80 et seq., Ala. Code 1975 ("the Act"), a codification of the federal Interstate Agreement on Detainers, 18 U.S.C. App. 2 ("the IAD"). The Supreme Court granted certiorari review to consider whether, as a matter of first impression, its Court's statewide suspension of jury trials in response to the COVID-19 pandemic tolled the Act's 180-day time limit for bringing a prisoner to trial. Warren Averett Companies, LLC, sought a writ of mandamus to direct a circuit court to vacate its order denying Warren Averett's motion to strike the jury demand asserted by Gerriann Fagan and to enter an order granting the motion to strike the jury demand. The underlying dispute involved a business proposition Warren Averett made to Fagan to to build a human-resources consulting practice. Fagan would wind down the operations of her company, The Prism Group; Fagan would then become a member of Warren Averett, and Warren Averett would purchase The Prism Group's equipment and furniture, assume responsibility for The Prism Group's leases; and that Warren Averett would assume The Prism Group's membership in Career Partners International, LLC. The "Standard Personal Service Agreement" ("the PSA") entered into by Fagan and Warren Averett drafted by Warren Averett included, in pertinent part, a dispute-resolution clause. Fagan resigned from Warren Averett after a salary dispute, and, on February 28, 2019, Fagan filed a demand for arbitration with the American Arbitration Association ("AAA"). The AAA determined that, under its rules, Fagan owed $300 and Warren Averett owed $1,900. The AAA also stated that any dispute regarding the filing fees should be raised before the arbitrator for a determination once all the filing requirements, including payment of the fees, had been satisfied. Warren Averett refused to pay its share of the filing fees as requested by the AAA, and the AAA closed the file in the matter. Thereafter, Fagan sued Warren Averett alleging multiple causes of action. Fagan demanded a jury trial. Warren Averett moved to dismiss the claims, and concurrently moved to compel arbitration. The Alabama Supreme Court determined Fagan did not show prejudice by the almost two-year delay between the filing of Fagan's amended complaint and the filing of Warren Averett's motion to strike the jury demand: "The trial court granted Warren Averett's motion to compel arbitration, and Fagan sought review of that decision. We reversed that decision; on remand, the trial court set a scheduling conference, and Warren Averett filed its motion to strike Fagan's jury demand. Although there was a delay between the time that Fagan demanded a jury and the time that Warren Averett sought to strike that demand, Fagan has not shown that she was prejudiced by that passage of time." Plaintiff Terri Anderson appealed the grant of summary judgment entered in favor of the defendants. At issue was an agreement to purchase certain residential property located on Ono Island in Baldwin County, Alabama ("the property") for $1.4 million. In 2012, Robert Bowling III acquired the property and executed a promissory note in favor of Merchants Bank. Merchants Bank subsequently assigned the promissory note and its mortgage interest in the property to Wells Fargo Bank ("Wells Fargo"). In 2018, Bowling conveyed his interest in the property to Robin and Michael Coleman via a vendor's lien deed. The Colemans executed a promissory note evidencing a debt to Bowling. In 2020, the Colemans conveyed a partial interest in the property to their friends, France Frederick and Thomas Sparks. In March 2021, the Colemans, Frederick, and Sparks entered into a purchase agreement regarding the property with Anderson. In April 2021, the sellers decided they had made a mistake by agreeing to sell the property. Robin Coleman eventually sent a communication to Anderson's realtor explaining, in relevant part: "We have voided the contract you sent us and have decided to keep our property." Anderson then initiated this action seeking an injunction prohibiting the sellers from violating the terms of the purchase agreement and a judgment requiring specific performance under the terms of the purchase agreement or, as an alternative to specific performance if the court were to determine that such relief was unavailable, damages for breach of contract. The sellers moved to dismiss Anderson's complaint, arguing that title to the property was unmarketable due to Bowling's and Wells Fargo's respective unsatisfied interests in the property. Accordingly, they contended, the language of the purchase agreement required a refund to Anderson of her earnest-money deposit and an automatic termination of the purchase agreement. The Alabama Supreme Court held only that the sellers could not invoke the marketability requirement of the termination provision set out in the purchase agreement to unilaterally rescind the purchase agreement under the circumstances presented by the record because it appeared that Anderson was willing to waive marketability of the sellers' title to the property to purchase whatever interest they were able to convey and because the sellers have expressly agreed to sell their interest in the property to Anderson, provided that the other pertinent contingencies of the purchase agreement were met. The Wilcox County Board of Education ("the Board") and individual Board members were defendants in a lawsuit filed by Jane Doe. Defendants petitioned the Alabama Supreme Court for a writ of mandamus directing the Wilcox Circuit Court to grant their motion for a summary judgment on the ground that they were entitled to immunity. On November 11, 2010, Doe, at that time, was a 12th-grade student at Wilcox County Central High School, was sexually assaulted by the principal of the school, James Thomas. According to Doe, Thomas made inappropriate comments of a sexual nature to her while she was serving as an aide in the school office and later called her into his private office, closed the door, and began kissing her and touching her. Doe reported the incident, and, as a result, Thomas was arrested the following day by the Wilcox County Sheriff's Department. After his arrest, Thomas was suspended from his duties as school principal and placed on administrative leave. He was ultimately convicted of having sexual contact with a student under the age of 19 years. In 2012, Doe initiated an action against Thomas, the Board, the individual members of the Board, and other individuals identified as former Wilcox County school-system superintendents. Doe asserted negligence and wantonness claims against the Board and the Board members, contending that those defendants had had knowledge of previous instances of similar misconduct by Thomas that they had allegedly failed to properly investigate or report. Doe also asserted claims of negligent or wanton hiring, training, and/or retention of Thomas against the Board and the Board members. The Supreme Court concluded the Board and the Board members, insofar as the Board members were sued in their official capacities, are entitled to immunity from the claims asserted against them but that the Board members were not entitled to State-agent immunity from the claims asserted against them in their individual capacities.
